Policy

As a manufacturer in the Defence Industry, there is a requirement for General Dynamics Land Systems - Canada to be registered in Canada under the Controlled Goods Directorate (CGD). U.S. and Canadian suppliers also require registration under their respective legislation when providing defence articles, services and data to General Dynamics Land Systems - Canada. As part of compliance under the CGD, General Dynamics Land Systems - Canada maintains records on the registration status of all quoted Suppliers with respect to governmental registration programs for participation in the defence industry. Registration under the applicable program(s) is one prerequisite in permitting suppliers to legally transfer controlled goods to General Dynamics Land Systems - Canada.

As a result, General Dynamics Land Systems - Canada has the following policy:

General Dynamics Land Systems - Canada, as a CGD-registered company, will conduct business only with suppliers who:

  • are registered with their government to participate in the defence industry; or
  • have proven not to require registration (commercial material, technology, and/or services); or
  • are exempt from registration, by their government, but may still participate in the defence industry, e.g. Canadian Government Agency; or
  • are not required to register, as their government does not have a registration program (specific export licenses for defence material may still be required).

In addition, all suppliers (regardless of location) with suppliers in the U.S. or Canada, must ensure their entire supply chain is aware of, and complies with this policy.

Determine Registration Status

Suppliers are the most knowledgeable about the products they sell; and therefore, are the best suited to determine if they need to be registered and if their goods need to be licensed. If in doubt, suppliers should hire a consultant or check with their government agency.

Obtain Approvals

General Dynamics Land Systems - Canada expects that its U.S. suppliers of goods, services and data will obtain the necessary approvals to export their goods, services and data from the U.S. to General Dynamics Land Systems - Canada and through to our end-use customer. We require the supplier to provide us with a hardcopy of that approval or proof of exemption prior to shipping product to us.

We need this documentation to support our export permit applications for finished vehicles, spare parts and product support out of Canada.

Identify Which Supplier Designs are Controlled

There are many instances where we integrate a supplier's product into our vehicles. It is not always known to General Dynamics Land Systems - Canada if the product a supplier has designed is a controlled good or not. Suppliers responsible for the design of their products are expected to know and advise General Dynamics Land Systems - Canada if their product is controlled. This will help us determine if a license is required, and what controls we may need to apply internally to supplier designed product or data.

Initiate DSP-83s and End Use Certificates

Some suppliers may require a DSP-83 or end use certification to be signed by General Dynamics Land Systems - Canada and/or our customers to support their export license application. A DSP-83 is a form used in the U.S. to certify the end use and non-transfer of a controlled good. In other countries, variations of an end user certificate are used. The supplier must initiate the document by filling in the required information, then forward the form to their General Dynamics Land Systems - Canada buyer. The supplier needs to specify who they want to sign the document. The buyer will then forward the document internally so the appropriate signatures can be obtained. The buyer will then return the signed original to the supplier.

License Quantity - Production

General Dynamics Land Systems - Canada production purchase orders indicate the quantities we require. Suppliers should indicate the line quantity on their export license application. The purchase order contains end use information, which can be used to support the supplier's export license application. Contact scm-ec@gdls.com for a current list of foreign consignee and foreign intermediate consignee's. Suppliers could end up applying for additional licenses if the release quantity is used instead of the line quantity.

License Quantity - Aftermarket

Aftermarket or spares purchase orders are unique. We cannot predict when a customer will order spares or how many will be ordered. Unfortunately, this means suppliers will need to apply for a license each time we issue a purchase order for spare parts.

When to Apply for a License

In some cases, the license approval process may take longer than it does to produce the parts. To prevent any undue delay in shipping, suppliers must apply for their export licenses as soon as they receive a purchase order from General Dynamics Land Systems - Canada. This is especially important for aftermarket purchase orders where there may be a customer who needs a replacement part quickly.
